Undertaking and Indemnity Form
In consideration of PSA Corporation Limited (hereinafter called “PSA”) agreeing at the request of permitting a group of visitors (hereinafter collectively called the “Tour Group” and individually called the “Visitor”) to enter the premises of PSA for the purpose of visiting:

1) PSA terminal(s);
2) PSA building; and/or
3) any other PSA occupied premises
​
All visitors are required to read and acknowledge the following Terms and Condition set out in Undertaking and Indemnity Form.
Agree and undertake the following:

To be responsible for the personal safety of all members of the Tour Group and to make provision for one person to supervise every tour group of 10 persons;

To comply with the Personal Data Protection Act (2012) in the collection, use and disclosure of Visitors’/Drivers’ personal data. In particular, to obtain Visitors’/Drivers’ consent in relation to the disclosure of Visitors’/Drivers’ personal data to PSA for the purposes set out herein. For the avoidance of doubt, PSA will collect, use and/or disclose Visitors’/Drivers’ personal data for the purposes of (i) verifying their identity; (ii) to contact them regarding matters related to the visit, and (iii) publicity purposes including but not limited to publications by PSA;

To bear all liability and fully indemnify PSA against any and all actions, claims, proceedings, costs, damages, legal costs and/or other expenses arising out of a breach of any of the undertaking(s) as stated in paragraph 2 above;

That the Tour Group shall report punctually at the agreed meeting place;

Subject to, and insofar as not inconsistent with, any written law, to absolve PSA including its servants and agents from all liability whatsoever in respect of any injury including fatal injury, loss, cost or expenses however occasioned and whether or not by any act, omission or neglect of PSA, its servants or agents which all or any one of the members of the Tour Group may suffer or sustain by reason of or during the said tour;

Subject to, and insofar as not inconsistent with, any written law, to indemnify and keep harmless PSA including its servants and agents against all proceedings, suits, actions, claims, demand, costs and expenses whatsoever which may be taken or made against its servants and agents in respect of injury (including fatal injury) loss, destruction or damage of property suffered by any one or all the members of the group howsoever occasioned; and

To pay to PSA, on demand, in respect of any claims (including all legal costs incidental thereto) made by PSA against us for any damage to its property or any injury (including fatal injury) caused to its 2 property or any injury (including fatal injury) caused to PSA ’s servants or agents arising directly or indirectly out of any act, omission, negligence or other default or any one of all the members of the Tour Group;

Annex A – TERMS AND CONDITIONS

1. DEFINITIONS
1.1 Unless the context otherwise requires:
“Operational Areas” means any place within the Restricted Areas where the conveyance, loading, unloading, handling or storage of goods takes place and include wharves, wharf aprons, container freight stations, transit and backup warehouses, alleyways, eaves of container freight stations, roadways, hardstandings, container yards, chassis yards, interchange areas, any place on board vessels and any other place deemed as such by PSA.
“Restricted Areas” means PSA’s premises which are designated as protected places pursuant to Infrastructure Protection Act and/or free trade zones pursuant to the Free Trade Zone Act (Chapter 114) and any other PSA’s premises as may be determined by PSA from time to time which access requires the production of PSA Pass and/or any other documents as required by PSA from time to time.
2. ACTIVITIES
2.1 The Visitor shall exercise due care and diligence for his own safety and that of others and shall comply with all laws and regulations relating to his safety, health and welfare including the Workplace Safety and Health Act 2006 and all its regulations, rules, orders, directions promulgated pursuant thereto and observe generally accepted safe work practices. The Visitor shall also comply with all safety rules, practices and requirements that may be implemented by PSA at any time and from time to time.
2.2 The Visitor shall, upon entry into the Restricted Areas, declare to the PSA security officer all articles (except goods for shipment or s torage and personal effects) which he is bringing into the Restricted Areas and, upon exit from the Restricted Areas,.
2.3 The Visitor shall have the NRIC or passport with him at all times while in the Restricted Areas and must produce the same for inspection as and when required by PSA.
2.4 The Visitor shall not photograph or film any part of the Restricted Areas without a valid PSA Photographer’s Pass. The Visitor is also prohibited from posting any photograph and / or video of PSA and / or its related events in any social media platforms and to refrain from commenting and / or responding to any discussions on or about PSA on the internet.
2.5 The Visitor shall comply with all rules, regulations and lawful directions given by any authorised officer of PSA or as indicated by any signboard upon entering and/or within the Restricted Areas.
3. SAFETY BEHAVIOUR/CONDUCT OF VISITOR
V811 To ensure that no smoking is allowed at all times, except in smoking areas.
S812 To ensure that no port or other property is vandalised or otherwise tampered with, damaged, impaired or destroyed.
S813 To ensure that there is no littering or spitting at all times.
L801 To ensure that a safe distance from equipment gantry paths is maintained at all times.
L803 To ensure that discipline and order are properly maintained at the work areas at all times.
V806 To ensure that a safe distance from a container which is lifted or lowered is maintained.
S807 To ensure that a safe position is maintained at the edge of ships, hatches, cargo stacks, container tops, unguarded openings, wharf aprons, equipment or work areas at all times.
S808 To ensure that all persons are kept clear from all areas between suspended load and stationary object.
V809 To ensure that all persons are kept clear from any suspended load, path of suspended load, unstable stack or path of moving equipment at all times.
V810 To ensure that all persons are not under the influence of alcohol or drug or any substance which may impair their judgment or action.
S849 To ensure that a safe position is maintained in and around the operational areas at all times.
4. PSA TRAFFIC RULES
VT26 To ensure that no hand-held communication device is used while driving.
DT47 To ensure that all drivers carry with them valid driving licences at all times.
ST48 To ensure that all drivers drive with due care and attention at all times.
ST28 To ensure that all drivers maintain road discipline in congested areas and avoid unnecessary horning.
VT46 To ensure that there is no reckless and/or dangerous driving at all times.
VT49 To ensure that no accident is caused by careless, negligent or inattentive driving.
LT06 To ensure compliance with the speed limit of 40 kmph at all times.
LT07 To ensure compliance with the speed limit of 15 kmph to 25 kmph in the operational areas at all times.
ST14 To ensure that there is no overtaking at emerging lanes.
LT15 To ensure that vehicle lights are switched on when driving at night or when visibility is low.
LT16 To ensure that there is no driving at the wharf and in the operational areas unless permission is granted.
ST21 To ensure that there is no driving against the flow of traffic.
ST22 To ensure that there is no driving under the backreach of quay cranes.
ST23 To ensure that there is no cutting across from any yard block to another.
ST24 To ensure that there is no driving between any 2 quay cranes, except for the purpose of entering the wharf and where there is at least 80 feet clearance between any 2 such quay cranes.
LT01 To ensure compliance with all traffic signs and markings, traffic lights and height restrictions at all times.
LT02 To ensure compliance with all traffic directions given by any authorised officer in and around PSA premises at all times.
LT03 To ensure that loads are properly secured when being conveyed by vehicles.
LT04 To ensure that passengers are carried on motor and/or goods vehicles only when authorised to do so and in a safe manner.
LT08 To ensure that unbroken white lines are not crossed.
LT09 To ensure that there is no obstruction to the flow of traffic at all times.
ST10 To ensure that no accident is caused by any obstruction to the flow of traffic.
LT11 To ensure that there is no obstruction at box junctions at all times.
ST12 To ensure that there is no obstruction on gantry paths at all times.
VT13 To ensure that no accident is caused by any obstruction on gantry paths.
LT17 To ensure that ambulances, fire brigades and/or police vehicles are given way to.
LT18 To ensure that persons on pedestrian crossings are given way to.
LT19 To ensure that only vehicles with tyres in good condition are used.
LT20 To ensure that vehicles are parked only at authorised or designated parking areas.
ST25 To ensure that yard cranes engaging in cross-gantrying are given way to.
5. PROPER PROTECTIVE APPAREL
V104 To ensure that a seat belt is properly worn at all times when driving any vehicle.
L149 To ensure that all suitable protective apparels including protective footwear and safety helmets acceptable to PSA are properly worn at all times (if applicable).
